Terms of Use - Theradios

These Terms of Use ("Terms") govern your use of the Theradios services, including but not limited to the website located at theradios.ca, any associated subdomains, and any mobile applications (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms By accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Use of the Service a. You must be at least 13 years old to use the Service. b. You agree to use the Service only for lawful purposes and in accordance with these Terms and any applicable laws and regulations. c. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. d. All content, features, and functionality of the Service are owned by Theradios or its licensors and are protected by copyright, trademark, and other intellectual property laws. b. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Service without the prior written consent of Theradios, except as provided below:

• You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
• If the Service provides functionality to share content, you may share links to such content through social media platforms or email, provided that such sharing is for personal, non-commercial purposes only.

4. User Content a. You retain ownership of any content that you submit, post, or display on or through the Service ("User Content"). b. By submitting User Content, you grant Theradios a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and Theradios's business, including for promoting and redistributing part or all of the Service in any media formats and through any media channels.

5. Privacy Your use of the Service is subject to Theradios's Privacy Policy. By using the Service, you consent to the collection and use of your information in accordance with the Privacy Policy.

Theradios does not guarantee that the Service will be uninterrupted or error-free, or that defects will be corrected. c. Theradios disclaims all warranties, express or implied, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability To the fullest extent permitted by law, in no event shall Theradios be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use or inability to use the Service.

8. Indemnification You agree to indemnify and hold Theradios and its officers, directors, employees, agents, and affiliates harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

9. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ottawa, Canada.

10. Changes to Terms Theradios reserves the right to modify or revise these Terms at any time. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
